Booking Terms & Conditions 

  1. Contract

The Booking Confirmation Form and these Terms and Conditions will form the basis of the contract between the Booking Contact and the Owner. The Booking Contact must be 21 years old or older and must have the authority of the other persons in the party to make the booking on their behalf.

These Terms and Conditions are deemed to have been accepted by the Booking Contact on payment of the Deposit to Tolga Keskin on behalf of Gunay’s Garden Villas, Gumruk Sok. Kaya Koy. Fethiye. Muğla. 48300.

  1. Owner’s Responsibilities

Owner takes full responsibility for the services which he/she is contracted to provide and are under his/her direct control. These are limited to reservation arrangements and making available the accommodation, its furnishings, appliances, contents and any private external facilities, all as materially described in our own promotional material and on the web-site at the time of booking.

Whilst it is anticipated that all other arrangements and services will proceed smoothly, Günay’s Garden Villas is unable to accept responsibility for the acts or omissions of any third-party organisation from whom you may receive services, notwithstanding that those third parties may have been introduced to you by ourselves. Such services will include inter-alia, airport transfers, car hire, tours and activities. Günay’s Garden is also unable to accept responsibility for certain local factors outside his/her control that you may experience. These include electricity and water supply, local fauna, roads and building works. If for any reason Günay’s Garden are unable to accommodate you in the accommodation you have booked due to other unforeseen and unavoidable circumstances; domestic, technical or safety issues, we will endeavor to find alternative accommodation within the same area and to the same or higher standard and value. If alternative accommodation is unavailable Günay’s Garden will refund all monies paid in respect of accommodation and transfers only.

  1. Force Majeure

In the unlikely event that Günay’s Garden is obliged to cancel your holiday we will refund all monies paid by the Booking Contact. It is regretted that Günay’s Garden can accept no other liability. Günay’s Garden cannot refund or pay any compensation for reasons of ‘force majeure’.  Reasons for force majeure include, inter-alia, war or threat of war, terrorism, natural disaster, extreme weather conditions, travel restrictions and nuclear disaster. (Your own personal holiday insurance should cover you for any of the above)

COVID-19 – (Updated March 24, 2021):  All bookings scheduled to take place in the year 2021 only will be reviewed and assessed on a weekly basis, and any resulting changes will be dependent on the ongoing developments with the world pandemic COVID-19 virus. These assessments will be based on official Turkish Government regulations and announcements and resulting decisions will be advised to clients no later than four (4) weeks prior to the reservation date.  (All 2022 reservations will be subject to our Standard Terms & Conditions).

  1. Cancellation or Partial Cancellation by the Booking Contact

No refunds will be made in respect of cancelled confirmed bookings. It is recommended that the Booking Contact should take out appropriate Cancellation Insurance. We cannot be held liable for third party cancellations.

Booking Contact to pay a 25% deposit of the total amount to secure dates. Booking Contact understands this fee is non-refundable and the final balance must be paid no later than 12 weeks prior to the event. Should booking contact need to reschedule their booking we will try to accommodate where possible. There will be a £35 administrative fee for doing so. If contact decides not to proceed and not fulfil the booking contract dates anything within four weeks prior to the arrival date, then no transfer of booking will be accommodated due to loss of enquiries and monies for said date. Cancellation of booking between 8 and 4 weeks before the arrival date 75% of monies paid will be transferable to a new booking. Anything less than 4 weeks prior to the arrival date contact would have to claim against holiday insurance.

  1. Booking Contact’s Responsibilities

It is the responsibility of the Booking Contact to inform everyone in their party as follows: –

  • That they should ensure that they have a full passport valid for at least 6 months beyond their holiday dates
  • That they should check with their doctor at the earliest opportunity regarding any vaccination or inoculation requirements. (not generally necessary, your standard inoculations are considered reasonable protection)
  • That unless otherwise explicitly stated, gardens, swimming pools and grounds in general are unsupervised.  It is the responsibility of all guests to ensure that they behave in a responsible and safe manner and that children are supervised at all times Günay’s Garden cannot be held responsible for illness, injury or death caused by the acts and/or omissions of the person(s) affected or those of any third party.
